We’re used to hear about many trial cases being postponed due to the
absence of lawyers at court. But the Tirana Civil Court is facing a new
phenomenon recently.
Trials are being postponed because of the changed names of ministries. Every Ministry that has changed its name must appear at the Tirana Civil Court with the new name.
Regardless the fact that all parties were present in the courtroom, even the expert who was about to explain how 170.000 square meters of land passed from the Air Forces to the civil airport, Judge Neritan Cena was obliged to postpone the session.
The Ministry of Economy, Trade and Energy has changed its name to the Ministry of Economic Development, Trade and Enterprise. The subject that has been sued does not exist anymore, legally, and the procedures of the new name must be completed first.
The same situation was created with the Ministry of Tourism, Culture, Yuoth and Sports.
The Court of Tirana postponed 30 sessions for this reason, for cases involving the Ministry of Education, the Ministry of Agriculture, the Ministry of Social Matters, the Ministry of Public Works and Transportation and the Ministry of Environment, all changed in name and structure.
Most of the lawsuits demand the repeal of administrative acts, job relations, contractual relations, opposition of bailiff decisions and caused damage. The postponement doesn’t affect laws in which are involved the Interior Ministry, the Ministry of Justice, the Ministry of Defense, the Ministry of Finances, the Foreign Ministry, the Ministry of Integration and the Ministry of Health.
