The case of Arben Isufaj, also known as Ben Qimja, might turn into an unprecedented battle between courts.
Four days before he was freed from detention, as the Court of Appeal decided this Friday, the Court of First Instance issued another security measure for the 45-year-old, leaving him in prison again.
The decision was declared right after another judge, Fatime Decolli, opened the extradition procedures to Italy.
The lawyer of Ben Qimja asked more time to get a better look to it, which was fulfilled by the court.
While this request was probably used by the defense to let the detention time expire, the Prosecution made another unexpected move.
Right after the first decision for the extradition, another judge, Neritan Cena, gave another arrest measure. He left the 45-year-old in prison, removing this way his desire to leave the cell on Wednesday.
Since the Albanian judiciary has made surprises with Isufaj in the past, it remains to be seen what the Court of Appeal with do with the second measure.
The verdict of the Court of Tirana will be given on April 15th. They will decide whether the extradition request for Arben Isufaj will be accepted. In both cases, the Albanian judiciary will be facing a challenge.
