Battle for Lezhe seat

The Socialist Party warned that they will not allow the current
government to take away from them one Parliamentary seat in Lezhe, which
gives to the new majority the opportunity to take all constitutional
decisions without the opposition.

In an interview for Top Channel, Damian Gjiknuri, secretary of the Socialist Party for electoral matters, declared that the Central Election Commission decision is against the law, since it is not based on article 123 for the obligations of the Central Election Commission to bring up a result.

“Everything that happened yesterday is another violation of the rules of the game, as in 2011”, he declared.

According to Gjiknuri, all the violations in Lezhe are an indicator of how problematic the June 23rd elections were. He says that Socialist Party is preparing an appeal which is based on the Electoral Code. The first phase of the appeal is made at the Central Election Commission.

But can the Central Election Commission review this appeal?

“According to the Electoral Code, and I am quoting article 22.5, the Central Election Commission’s meeting are valid only when they have five members. In this case the Central Election Commission does not have the competency and the quorum to review the appeals of the parties in this phase of the process. The only thing that they can do is to identify their inability and sent the case to the Electoral College, which will review the entire electoral problematic, not only for Lezhe but for every other appeal that the other political forces might have for the electoral process”, Gjiknuri declared.

If this procedure is not implemented and if the Central Election Commission will take a final decision, but not sending it to the Electoral College, Gjiknuri say that they will be having a law vioalation as in 2011, when the Central Election Commission opened the ballot boxes without a legal basis.
