Basha’s SMS, Commissioner: Privacy infringement

The commissioner of the Personal Data Protection, Flora Çabej, declared
that the law of Personal Data Protection has been infringed by
politicians who have sent electoral SMSs to the citizens without their
authorization.

“There is no doubt that this is a law infringement, because no one has the right to do it without authorization. When the citizens sign a contract with their companies, they should give a written authorization if they want their data given for such purposes or not”, Çabej said.

Mrs. Çabej said that her institution has started taking measures against the cellular companies that allow personal data to be used, although she admits that the law sanctions are not efficient for this matter.

“We have had citizens complaining about this. We starting acted after the many messages that arrived at our cell phones. We have been inspecting, recommending and putting fines to the cell phone operators, because they should have respected the law”, the Commissioner said.

The opposition has accused the Democratic Party candidate for the Tirana Municipality, Lulëzim Basha, of misusing the individual personal data, after some people received messages that included birthday congratulations, which is not classified as a public data.

The commissioner gave this declaration from an activity held by the American Chamber of Commerce.
