Appeal expected to rule on January 21st case

The defense says that the two National Guard officers are innocent and what they did on the January 21st tragic demonstration was part of their job, which is guarding the institutions. The Prosecutors challenged the verdict of the Court of First Instance, which, according to them, was given without analyzing the evidence.

The Prosecution says that for Ndrea Prendi, this court verdict doesn’t even state why he is innocent, especially when the charges are personal and not related to the National Guard of the Republic. As for the victims,  prosecutors say that the court has not even explained where they were and what they were doing.

“The victims have concrete names and minimally, the court should have mentioned each of them, not simply identify them with the crowd”, the Prosecutor declared.

Referring to the evidence, the Prosecutor reminded that Hekuran Deda was sitting on the journalists’ platform and was not being aggressive. Ziver Veizi was facing the Prime Minister’s office without doing anything, same as Faik Myrtaj.

Prosecutors said that the court asked them the motive, but they forget that in such cases, the crime becomes intentional due to the fact that Ndrea Prendi and Agim Llupo had foreseen the consequences before shooting against the demonstrators.

As for the Giuliani case, taken as reference by the court, the Prosecution says that it is a serious violation of the code, since analogy is not allowed in penal cases.

However, defensive lawyers replied by remdinding that the Strasbourg verdicts have been used as sources for the Albanian laws.
