Even after the debate between the majority and opposition Parliament
Members, in which was declared that the Chair of the Audiovisual Media
Authority (AMA) had her mandate expired and her stay in that post is
illegal, she reacted by saying that her mandate is legal.
Mrs.Endira Bushati underlined that according to the past law, one of the members was chosen as Chair and Vice Chair of AMA.
“The mandate of Chair and Vice Chair was different from the mandate of members. When a National Council of Radio Television was chosen Chairman or Vice Chairman, the elected person enjoys the mandate as chairman or vice chairman. For every mandate is chosen a replacement, for a time that is equal to the time remained to the predecessor”, Bushati says in her declaration.
The Deputy Chairman of the AMA, Alfred Peza, declared that according to the new law of AMA, Mrs.Bushati is completely illegal, what has put AMA in a stalemate. Mr.Peza has explained that the opposition Parliament Members at the Commission of Laws have agreed on this point.
“The declaration is a mechanic unification of references. It addresses to the old law when it is convenient, and to the new law when convenient. Mrs.Bushati is holding her duty illegally, since her membership mandate is over, and as result also the mandate as chairwoman. There has been no opposition by the opposition members in Parliament, who have many renowned law experts”, Peza declared.
Bushati underlines in her declaration that she has been elected as chairwoman and her mandate continues until July 2016. Peza reminds that this stance is illegal.
“Mrs.Bushati doesn’t have a mandate as member, that’s why she cannot be chairwoman without being a member. She cannot lead the institution if you are not a member. This has been resolved with a special decision of the Constitutional Court. There are precedents in these 23 years, such as the case of the former President of the Court of Cassation, Avni Shehu, in 1999, when the Constitutional Court declared that no one could be head of an institution without being its member”, Peza declared.
The vacancies at AMA will be filled after Peza’s amend will pass in Parliament.
