Albania will have a public debate about the need to make constitutional
amends or not. Most of constitutional experts, several politicians and
two former presidents who were invited today in the first debate,
declared that the Constitution needs to change by affecting the way how
the President is elected, in order to not allow this process to be a low
political bargain.
“In order to continue with the reform and not turn it into another political division in Albania, it is important to give an answer to this question? Is there a need to make constitutional reforms in Albania?”, declared Gent Ibrahimi, executive director of the IPLS.
“As for the question if there is political will in this reform, I am here to say that yes, we have the political will for this reform”, declared Fatmir Xhafa, Chairman of the Commission of Laws.
16 years from the passing of the Constitution, the law elite in Albania has opened the public debate if the constitutional reform is a priority or not, and there have been stances in favor and against.
“I believe that this has been exhausted. This is hurting for the political group I am part of, because we wish we could make some amends, at least against those of 2008”, declared Ylli Manjani, Deputy Minister of Transports.
“The adequate instrument to answer to the political conflict is not the Constitutional amend, but the constitutional jurisprudence”, declared Ilir Rusmali, former chairman of the Commission of Laws.
“The election of the President is a political bargain. We think that the President should be elected by the people”, declared the former President, Alfred Moisiu.
“I believe that the stance I want to share with you is that the current priority in Albania is the implementation of the Constitution”, declared Oerd Bylykbashi, Democratic Party Parliament Member.
“Or problematics that are related to the rotation of the Constitutional Court. There is no disposition so far. The Constitution refers it to the law and the law refers it to the Constitution”, declared Aurela Anastasi, Professor at the Constitutional Right.
The initiative for starting a wide public debate is led by the Foundation “Open Society for Albania”, whose executive leader says:
“We have a need for reform and for readiness from the public opinion, which do not need to be on the same track. I believe that the readiness of the public opinion is the track that should dictate the readiness of the political class”, declared Andi Dobrushi, executive director of OSFA.
One of the main arguments for the Constitutional Reform is the need to review the amends of 2008, and the repeated crises in the relations between the Parliament and the Prosecutor General, the election of the Ombudsman and appointment of the Supreme Court and Constitutional Court judges.
