The Administrative Court of Appeal in Tirana, which reviews all cases
that come from the First Instance of the Administrative Court, demanded
the attachment of a judge panel with legal advisors, as provided by the
law.
The Chancellor of this Court, Leonard Strataj, declared that the Court is in an overloaded situation, since the entire flux of cases is being handled by seven judges, with each of them reviewing at least 90 cases per week, obliging the administration personnel to work overtime and even weekends.
“We have a very overloaded situation and every judge needs his legal advisers as soon as possible, and the administration must the judiciary secretary, because we are working with one secretary for three judges. The Court of Appeal administration is overloaded. People come to work from eight in the morning at eight in the evening. They even work on Sundays. The law of the Administrative Court provides one or two legal advisers for each judge”, declared Leonard Strataj, Chancellor of the Administrative Court of Appeal in Tirana.
After the Supreme Court demanded every other court to pass the competences to the Administrative Court, the flux of cases went beyond any prediction. 5000 cases have been filed so far, and the capacities for facing the situation are very small.
“The problem is that cases have a 1-month deadline and the judge panel is postponing them to three or four months. The court is currently working with the cases of March”, Strataj declared.
The Administrative Court of Appeal has given verdicts for 2500 cases so far, while six of the First Instance Courts in the entire country appeal 300 cases per week.
