10 000 lawsuits by Albanian workers for unfair dismissals or discrimination, in both the state and private sector

From 2013, the financial bill for unfair dismissals paid to employees by court decisions is 17 billion ALL. This is confirmeds by the Ministry of Finance, including all the institutions sued over these years.

For the last five years, more than 10,000 citizens went to civil and administrative courts, suing private companies and state institutions, claiming that they were unfairly dismissed from work. Currently under review are 2441 lawsuits with the object of labor relations. So in another institution, that of the commissioner for protection against discrimination, dozens of citizens have complained not only about unfair dismissal, but also about lack of appreciation at work.

“There are 350 complaints, 150 of them directly about the work relationship. We notice non-respect of the rights, in one case of a woman dismissed from work during pregnancy, but there have also been cases of dismissal for political reasons”, says Darjan Konomi, specialist Commissioner for protection against discrimination.

“Currently, I have three clients who have filed lawsuits for termination of the employment relationship without respecting the terms of the contract”, said lawyer Klevis Boci.

But how protected are employers by the Labor Code?

“The private sector remains particularly problematic. We are noticing that the government complains to the courts about unfair evaluations, which then lead to the employee’s departure”, says the lawyer.

In some cases, the ombudsman has reacted with recommendations, among them for the reappointment of those removed from office after winning the process, while the court has also ordered to continue their pay as if they were in office.
