Eu and US experts, new Prosecutor General could be appointed by Parliament with just 36 votes

The mandate of the Prosecutor General, Adriatik Llalla, will end by this December 3rd.

With the new judiciary reform, the competence for appointing the new Prosecutor belongs to the High Council of Prosecution, which has not been established yet.

To resolve this dilemma, the two missions that assist Albania, Euralius from EU and OPDAT from the USA, suggest that the new Prosecution should be elected on a temporary duty until the High Council of Prosecution is established and that he should be appointed by the Parliament with just 36 votes.

Euralius and OPDAT say that the Parliament doesn’t have the constitutional or legal authority to prolong the mandate of the incumbent Prosecutor.

However, there is a clear disposition which orders the appointing of a new temporary Prosecutor General.

For this reason, the Prime Minister met this Tuesday at the Commission of Laws, but they also discussed removing CEC Chairman Zguri from power, who was appointed through the May 18th political agreement. If Zguri is dismissed, that will mean that the agreement is politically dead.
