DP calls “unconstitutional ” ban on rent payments: Violates property rights, incites conflict

The opposition DP deemed today unconstitutional a government normative act that suspends rents for small businesses, unemployed family members and students, in the framework of the Covid-19 protection measures.

DP’s Jorida Tabaku stated that this unprecedented act not only violates property and human rights, but will also promote social conflict among Albanians.

“Normally the leases act is unconstitutional, but it is also a violation of property rights and it is a violation of human rights. It is an act that fosters conflict between the parties, and in this case it is an act that fosters conflict between small businesses, family businesses that rent. We are not talking about big businesses or oligarchs that the government is protecting and covering. Here we are talking about deals between small businesses, which are usually the ground floors of old buildings.

“The intervention of the government in these agreements, besides being unconstitutional, in addition to violating human rights, is a very serious precedent for future decisions that this government will take. The government may suspend taxes, may delay taxes, may lower taxes for businesses but not interfere with these agreements. The government can do what Kosovo did, it can subsidize rents, this is what the government can do. It cannot interfere with the agreement between the parties”, stated Tabaku.
