Top Channel TV Application
If you agree to use thea pplication “Top Channel TV”, then you acknowledge that you have read these Terms and Conditions and have agreed to them in advance.
In case you do not agree with them, please do not proceed with accessing the service.
Please read the terms and conditions of theApplication carefully “Top Channel TV” before using it and before confirming its use.• Top Channel JSC, with headquarters in Tirana, with NUIS K12007002U, with headquarters at the address: Street: "17 Nentori", No.20, Mezez Koder, Komuna Kashar,Tirane, reserves all intellectual property rights in connection with the application. Any unauthorized use of the application by third parties is a violation of Albanian legislation in the field of intellectual property and is punishable by law.
• Internet provider on the Smart device where the application "Top Channel TV" is used (hereinafter referred to as "ISP"), provider of networks and mobile services of public electronic communication in accordance with the relevant Authorizations issued by the Electronic and Postal Communications Authority (hereinafter referred to as "AKEP"), which enables internet access in order to use this application.
If you are going to be a user of this application, then it is assumed that you have read these Terms and Conditions, and have agreed to them in advance before use. You have also agreed to the sending of application data (User & Password) by Top Channel and have accepted receiving messages from Top Channel on your mobile device or tablet connected to a Sim card, as well as any other message that may send Top Channel regarding the use and functionality of theapplicationTop Channel TV.
1. Application: "Top Channel TV" application is a service provided by Top Channel, according to the roles specified above. This application is available for smartphones, tablets and / or new technological forms that use the iOS and Android operating systems, and gives the opportunity to any User who has benefited from this service in the forms provided by Top Channel, to access the TV content of Top Channel through this application.
2. This service is variable and therefore may change from time to time, including the content of the channels made available to you through the technological equipment in your use. This is because part of the content placed at your disposal is provided by other broadcasters, and therefore, the availability of such content in certain cases is beyond our control).
3. Access to the service provided through this application, depends directly on fast enough internet access. In terms of internet speed, you can communicate directly with your internet provider.
4. The application can be downloaded on Google Play or the App Store by all users of mobile phone services in the territory of the Republic of Albania. More detailed and further information can be found on the website: https://top-channel.tv
5. The "Top Channel TV" application has the following main features: 1. LIVE TV, with TV channels. Generalist channels, news channels, movie channels, children's channels, documentary channels, music channels and sports channels. The list of channels can be changed by Top Channel by notifying the Subscribers in advance through the communication forms on the official website and directly with subtitles on the TV channels part of the application. 2. Catch Up The client can go back in time and watch programs that were broadcast, up to 72 hours ago. 3. EPG Each channel comes with a program guide, with the corresponding description. 4. Parental control Parental control to limit channel viewing according to the allowed age. 5. Favorite list Possibility to create a group of channels according to the Client's tastes.
Limited Liability Top Channel shall not be liable for any legal, financial or other liability to customers or third parties if the content of the Top Channel TV application cannot be provided due to an event that is beyond the reasonable control of Top Channel. Top Channel shall not be liable for damage caused or claims that may arise from: not 1. Connecting to the internet, its speed or blocking it; 2. Malfunction of the "Top Channel TV" application due to the unsuitability of your technological device; 3. Errors, inaccuracies in the functionality of the application, as well as the malfunction of the latter for reasons that do not depend on Top Channel; ç. Clients who access and use the application "Top Channel TV" in violation and not in accordance with these Terms and Conditions; 1. Disconnection of the Internet due to non-payment of the Service Provider and / or relations with the latter; 2. Violations committed unintentionally or due to negligence;
Top Channel does not guarantee and is not responsible for the operation of the device used to access the "Top Channel TV" application.
Regardless the information above, Top Channel TV is responsible to the Users for providing access to the “Top Channel TV” application as far as the existing legal framework for audiovisual media and consumer protection provides.
Access and Protection of Your Personal Data The Client agrees that Top Channel may conduct surveys regarding the types of programs for which the Subscriber is interested, in order to improve Top Channel programs and meet the requirements and needs of the subscribers. By accepting these conditions, you allow and authorize the application to access your data, to fulfill the purpose of this service and in full compliance with and respecting the Albanian legislation in force. In case of complaints about how your data from the "Top Channel TV" application has been used, you should contact: [email protected]. Your data accessed within the service provision of the application "Top Channel TV", will be stored securely by Top Channel on its servers, located at its headquarters, in accordance with the terms and conditions of the application “Top Channel TV ” by Top Channel until the end of the period during which they must be treated for service delivery purposes, but not more than 2 years. According to the applicable law, the Client has the right to access the data related to it and can request correction, modification or deletion of this information by contacting [email protected].

Top Channel reserves the right to monitor and record Customer calls made to the Customer Care Service in order to assess the quality of service in accordance with applicable Albanian legislation. OtherTop Channel reserves the right to change these Terms and Conditions at any time. Top Channel can also create new rules, which can be applied while using the application or cancel it for major reasons. If Top Channel will change the terms of service, or for any reason will terminate its provision in accordance with the provisions of this Contract, customers will be informed in advance through the official website https://top-channel.tv . Kushte dhe AfateAplikacioni “Top Channel TV”
Nëse pranoni të përdorni aplikacionin “Top Channel TV”, atëherë ju pranoni se keni lexuar këto Kushte dhe Afate dhe keni rënë dakord me to paraprakisht.
Në rast se nuk jeni dakord me to, ju lutemi të mos vijoni më tej me aksesimin e shërbimit.
Ju lutemi të lexoni me kujdes Kushtet dhe Afatet e Aplikacionit “Top Channel TV” përpara përdorimit të tij dhe përpara se të konfirmoni përdorimin e tij. • Top Channel SHA, me seli në Tiranë, me NIPT K12007002U, me seli në adresën: Rruga “17 Nentori”, Nr. 20, Mezez Koder, Komuna Kashar,Tirane, rezervon të gjitha të drejtat e pronësisë intelektuale në lidhje me aplikacionin. Çdo përdorim i paautorizuar i aplikacionit nga të tretët, përbën shkelje të legjislacionit shqiptar në fushën e pronësisë intelektuale dhe është i ndëshkueshëm nga ligji.
• Ofruesi i internetit në pajisjen Smart ku përdoret aplikacioni “Top Channel TV” (këtu e më poshtë referuar si “ISP”), ofrues i rrjeteve dhe shërbimeve celulare të komunikimit publik elektronik në përputhje me Autorizimet përkatëse të lëshuara nga Autoriteti i Komunikimeve Elektronike dhe Postare (ne vijim referuar “AKEP”), që mundëson aksesin në internet me qëllim përdorimin e këtij aplikacioni.
Nëse do të jeni përdorues të këtij aplikacioni, atëherë supozohet se i keni lexuar këto Kushte dhe Afate, dhe keni rënë dakord me to paraprakisht përpara përdorimit. Gjithashtu, ju keni rënë dakord dhe me dërgimin e të dhënave të aplikacionit (User & Password) nga Top Channel dhe keni pranuar marrjen e mesazheve nga Top Channel në aparatin celular dhe ose tablet të lidhur me një kartë Sim, si dhe çdo mesazh tjetër që mund të dërgojë Top Channel në lidhje me përdorimin dhe mirëfunksionin e aplikacionit Top Channel TV.
1. Aplikacioni: aplikacioni “Top Channel TV”, është një shërbim që ofrohet nga Top Channel, sipas roleve të specifikuara më lart. Ky aplikacion është i disponueshëm për telefonat smartphone, tabletet dhe/ose forma të reja teknologjike që përdorin sistemet e operimit IOS dhe Android, dhe i jep mundësinë çdo Përdoruesi që ka përfituar këtë shërbim në format e ofruara nga Top Channel, të aksesojë përmbajtjen televizive të Top Channel nëpërmjet këtij aplikacioni.
2. Ky shërbim është i ndryshueshëm dhe për këtë arsye mund të ndryshojë nga koha në kohë, duke përfshirë edhe përmbajtjen e kanaleve të vënë në dispozicionin tuaj nëpërmjet pajisjeve teknologjike në përdorimin tuaj. Kjo ndodh pasi një pjesë e përmbajtjes së vendosur në dispozicionin tuaj, ofrohet nga subjekte të tjera transmetuese, dhe për këtë arsye, disponueshmëria e këtyre përmbajtjeve në raste të caktuara është jashtë kontrollit tonë).
3. Aksesi në shërbimin e ofruar nëpërmjet këtij aplikacioni, varet në mënyrë të drejtpërdrejtë nga aksesi me shpejtësi të mjaftueshme në internet. Sa i takon shpejtësisë së internetit, ju mund të komunikoni direkt me ofruesin tuaj të internetit.
4. Aplikacioni mund të shkarkohet në Google Play ose App Store nga të gjithë përdoruesit e shërbimeve telefonike të lëvizshme, në territorin e Republikës së Shqipërisë. Informacion më të hollësishëm dhe të mëtejshëm mund të gjeni në faqen e internetit: https://top-channel.tv.
5. Aplikacioni “Top Channel TV” ka këto karakteristika kryesore: 1. LIVE TV, me kanale televizive. Kanale gjeneraliste, kanale lajmesh, kanale filmash, kanale për fëmijë, kanale dokumentarësh, kanale muzikore dhe kanale sportive. Lista e kanaleve mund të ndryshohet nga Top Channel duke njoftuar më parë Abonentët nëpërmjet formave të komunikimit në faqen zyrtare dhe direkt me titra në kanalet TV pjesë e aplikacionit. 2. Catch Up Klienti mund të rikthehet në kohë dhe të shohë programe që janë transmetuar, deri në 72 orë më parë. 3. EPG Çdo kanal vjen me guidën e programeve, me përshkrimin përkatës. 4. Parental control Kontroll prindëror për kufizimin e shikueshmërisë së kanaleve sipas moshës së lejuar. 5. Listë favorite Mundësia për të krijuar një grup kanalesh sipas shijeve të Klientit.
Kufizimi i Përgjegjësisë Top Channel nuk mban përgjegjësi ligjore, financiare apo të çdo lloji ndaj klientëve apo palëve të treta nëse përmbajtja e aplikacionit “Top Channel TV” nuk mund të ofrohet për shkak të një ngjarjeje që është jashtë kontrollit të arsyeshëm të Top Channel. Top Channel nuk mban përgjegjësi për dëmin e shkaktuar ose pretendimet që mund të lindin nga: 1. moslidhja me internetin, shpejtësia apo bllokimi i tij; 2. Mosfunksionimi i aplikacionit “Top Channel TV” për shkak të papërshtatshmërisë së pajisjes suaj teknologjike; 3. Gabimet, pasaktësitë në funksionalitetin e aplikacionit, si dhe mosfunksionimi i këtij të fundit për arsye që nuk varen nga Top Channel; ç. Klientë të cilët aksesojnë dhe përdorin aplikacionin “Top Channel TV” në kundërshtim dhe jo në përputhje me këto Kushte dhe Afate; 1. Shkëputja e internetit për shkak të mospagesës së Ofruesit të Shërbimit dhe/apo marrëdhënieve me këtë të fundit; 2. Shkeljet e kryera pa qëllim apo për shkak të neglizhencës;
Top Channel nuk garanton dhe nuk mban përgjegjësi për vënien në funksion të pajisjes së përdorur për të aksesuar aplikacionin “Top Channel TV”.Pavarësisht sa më lart, Top Channel TV është përgjegjëse ndaj Përdoruesëve për ofrimin e aksesit në aplikacionin “Top Channel TV” për aq sa e parashikon kuadri ligjor ekzistues për mediat audiovizive dhe mbrojtjen e konsumatorit.
Aksesi dhe Mbrojtja e të Dhënave tuaja Personale Klienti bie dakord se Top Channel mund të kryejë sondazhe në lidhje me llojet e programeve për të cilat Abonenti është i interesuar, me qëllim përmirësimin e programeve të Top Channel dhe plotësimin e kërkesave dhe nevojave të abonentëve. Me pranimin e këtyre kushteve, ju lejoni dhe autorizoni aplikacionin të aksesojë të dhënat tuaja, për përmbushjen e qëllimit të këtij shërbimi dhe në përputhje të plotë e në respektim të legjislacionit shqiptar në fuqi. Në rast ankese mbi mënyrën se si janë përdorur të dhënat tuaja nga aplikacioni “Top Channel TV”, ju duhet të drejtoheni në adresën: [email protected] . Të dhënat tuaja të aksesuara në kuadër të ofrimit të shërbimit të aplikacionit “Top Channel TV”, do të ruhen të sigurta nga Top Channel në serverat e saj, të ndodhur në selinë e saj, në përputhje me kushtet dhe termat e ofrimit të aplikacionit “Top Channel TV” nga Top Channel deri në fund të periudhës gjatë së cilës ato duhet të trajtohen për qëllime të ofrimit të shërbimit, por jo më shumë se 2 vjet. Sipas ligjit të zbatueshëm, Klienti ka të drejtë të aksesojë të dhënat në lidhje me të dhe mund të kërkojë korrigjimin, modifikimin apo fshirjen e këtij informacioni duke kontaktuar [email protected] .
Asistenca nga Shërbimi i Kujdesit ndaj Klientit Për çdo ankesë apo informacion lidhur me funksionimin e aplikacionit “Top Channel TV”, mund t’i drejtoheni Shërbimit të Kujdesit ndaj Klientit të Top Channel në adresën elektronike në vijim dhe/ose në faqen e internetit https://top-channel.tv/rreth-top-channel/kontakt/ . Top Channel rezervon të drejtën për të monitoruar dhe regjistruar thirrjet e Klientëve të kryera drejt Shërbimit të Kujdesit ndaj Klientit me qëllim vlerësimin e cilësisë së shërbimit në përputhje me legjislacionin shqiptar në fuqi.
