What MP Kryemadhi risks from not declaring her bank accounts abroad?

Monika Kryemadhi, former head of the SMI party and former First Lady of Albania, becomes the first Albanian politician whose undeclared accounts in foreign banks are discovered.

The documents published by Top Channel show payments made by Russian oil businessmen, with Mrs. Kryemadhi as the beneficiary, which she has not declared with the authorities.

In the conditions when Kryemadhi is a deputy of the Assembly of Albania, she is subject to the law on “Declaration and control of assets, financial obligations of elected officials and some public servants”.

These documents received via e-mail at Top Channel show that on February 15, 2017, she received a payment of 5,350 euros from the Holdem company, while a year later on May 23, 2018, another payment of 13,500 euros was made by Holdem.

The transfers are in small amounts but they show that bank accounts in banks in Switzerland and shares in offshore companies are hidden. These data, verified through documents, are enough to initially set in motion the High Inspectorate for the Declaration and Control of Assets and Conflict of Interest, according to Article 27 of the law, to summon the subject in this particular case, Mrs. Kryemadhi.

“The subject is called to give explanations when during checks it is discovered that the declarations are not correct or the declared sources are not identified and do not cover the declared assets. The High Inspectorate calls the subject to give detailed explanations and relevant arguments, which are always presented in writing within 15 days from the date of notification”, the law states.

In the conditions where Ms. Kryemadhi has not included in the periodic declarations the payments received in 2017 and 2018, respectively 5,350 euros and 13,500 euros, the law has this provision in article 38 for the consequences: “The presentation of false data in them constitutes a criminal offense and is punished according to the legislation in force”.

The High Inspectorate for the Declaration and Control of Assets and Conflict of Interests, as required by law should start the investigation of this case, and then it is the bodies of justice that should have their say.

If the SPAK special prosecution will prove the consummation of these criminal offenses and the court finds her guilty, then the former First Lady of Albania is to lose her mandate as a member of parliament.
