Vetting Law, what happens if fired Judges are brought back by the Strasbourg Court?

Many judges and prosecutors who are undergoing the vetting process, and who have failed to pass, appealed the decision at the new structure created with the judiciary reform, but their cases may go as far as to the Brussels court.

But what happens if the Strasbourg Court rules in their favor? Will they be reinstated?

Today’s guest on Top Talk, Erida Skendaj, Chairwoman of the Albanian Helsinki Committee, explains the possibilities: “Some of the cases are already at the Strasbourg Court, but the Albanian Vetting Law and Constitution have no legal measures for such cases. There could be a legal gap, and maybe the Strasbourg Court could order Albanian authorities to compensate them and to create any mechanism for reinstating them”, Skendaj said.
