SP Congress decision on Party Electoral Code

The approval of the Socialist Party Congress the request of the
Socialist leader, Edi Rama, to make a referendum within the party, is
provided by the Electoral Code of the SP.

Two articles sanction the process that will be followed for the referendum. But is the referendum date, April 9th, legal according the Electoral Code? Just three weeks after the congress?

The opponent of Rama, Ben Blushi, said this Monday on Top Channel’s Top Story that the referendum date is another violation. Article 56 of the Electoral Code says that referendums cannot be held two months before or after the party congress, or one month before elections of any kind.

One of the legal experts explained for Top Channel that the Congress Decision, however, remains the highest act in the hierarchy of party norms. The Congress can change the statute, while the Electoral Code is approved by the National Assembly and as such it is inferior to the hierarchy.
