SP: Alarm for judicial system

The Socialist Party reported what they consider the majority’s attempts
for taking the Constitutional institutions under control through actions
that fall against the Constitutions and the law.

The Socialist MP, Fatmir Xhafaj, gave this reaction of his party one day after Constitutional Judge Petrit Plloci resigned, as a sign of protest against the rejection of the President’s request that considered as anti-constitutional the blocking of three Presidential decrees by the Parliament.

“We report the government’s efforts for taking the independent institutions under control. The judicial system is in danger. The executive government and political segments influence most of the judicial verdicts”, Xhafaj declared.

Xhafej underlined that the Judicial Court decided to reject the President’s request for reviewing new appointments, an action that according to him falls against a decision issued by this court one week ago.

“Two of the judges whose mandate is not over, and who vowed on the Constitution that they will protect it, have violated their vows with the vote they gave to themselves. This vote realized the rejection of the Presidential Decrees”, Xhafaj underlined.

“The decision of this court, which today can be considered an illegal court, acme after they refused to review the Presidential requests and keeps holding three vacant places that they want to fill with the new President, for political goals”, the Socialist MP declared.

He launched other accusations against this Constitutional institution, claiming that they have limited the rights of the opposition, by allowing them to run the court only for inner matters of no national interest.

“The Court has deprived the opposition from its rights for addressing to the court. The lawmakers can address the Constitutional Court only when its close interests are damaged, rather than the Constitution and the laws. If this decision would have been taken two years ago, the SP would have not been able to complain for the maritime border”, Xhafaj declared.

The Socialist MP added that regardless the power balance, it is a Constitutional obligation for them. He warned that the SP will undertake initiatives for their consolidation.
