President’s conflict with government deepens

President Nishani returned the law for the organizing and functionality
of the Supreme Court, which was approved by the majority on December
2014.

The argues his decision with the lack of consultations and inclusiveness for the law amends.

“The law has not been consulted with the President, as it has been claimed, and it should be returned for a review”, says the announcement of the Presidency.

The President says that the law amends do not fulfill the expectancies of the European Commission, referring to the recent progress report, and it requires a constitutional amend. It doesn’t respect the principle of constitutional loyalty. The President says that the criteria of an average grade of 8 for the Magistrate School is not justified.

The President’s strongest opposing argument is the Council for Appointments at the Supreme Court, a structure that will be established based on the amends that were voted this December. According to the President, the establishing and the competence of this council go against law 136/1 of the Constitution.

It remains to be seen if the majority will review the law or if they will wait for the draft to turn into a law without any change.

A signal that the proposition will not change has been given by the Head of the Parliamentary Group of the Socialist Movement for Integration, Petrit Vasili, who said for Top Channel that the draft law is transparent and respect the Constitution.
