HCJ defends Gjin Gjoni

The High Council of Justice said “No” to the request of the Minister of
Justice to discharge Gjin Gjoni. Despite the criminal case opened
against him by the Prosecution for hiding assets, the HCJ has defended
the judge in question.

With one vote in favor of the discharging, given by the youngest member that came from the Parliament, Sokol Como, and 12 votes against the discharging, the HCJ rejected the request of Minister Naco.

The only ones who didn’t vote were Gjin Gjoni, who is also a member of the HCJ, and Minister Naco, who are not allowed by law to vote. Right after the request for discharging Naco was rejected, reserved sources declared that the Minister was asked to propose another disciplinary measure, as provided by law, but the Minister didn’t accept and declared that his only request was discharging him.

The judge in question, also member of the HCJ, defended himself by saying that the accusations do not stand. He considered this issue as a coordinated political attack, due to some verdicts he has taken against some current Ministers. Gjni declared that he is being attacked for pressure regarding some trials he is following.

Gjoni didn’t accept to give any details about his assets, and said that the High Inspectorate of Declaration and Audit of Assets refused to cooperate. Gjoni didn’t tell what cases about Ministers he was following, and no information was given from the Court of Appeal as well.

With this decision, the HCJ is about to spur more debates, since the judiciary corruption has turned into the key word of the day.

There are plenty of accusations against corrupted judges or suspicious verdicts, and there are many appeals from local and international factors for a deep judiciary reform.

The HCJ voted to give a warning to Andri Ymeri, rejected the request  for discharging judge Markelian Kuci, but, according to the HCJ, the measure requested by the Minister is a worse violation than the ones committed by him.

For the two judges of Elbasan, Bujar Musta and Ilir Pashja, the HCJ decided to postpone the request for disciplinary proceeding due to the inability of judges to appear and say their word.

The other request for the judge reported by Top Channel’s “Fiks Fare”, Shtjefen Lleshi, was also rejected. He will be heard together with the others in a special meeting that will be held this Friday.

The hopes of the Prosecution General are on the Supreme Court, with an appeal that might accept their persistence to suspend the Judge of Court of Appeal, Gjin Gjoni.

Gjoni’s suspension request was based on the report of the High Inspectorate of Declaration and Audit of Assets a few months ago, for hiding assets and falsifying documents, for a wealth that mounts up to two million EUR.

The case includes also his wife and two notaries, and it was initially deposited at the Prosecution General, which rejected it and passed it for investigation at the closest task unit to Tirana, that of Elbasan.

While the HIDAA declared they had found various violations and discrepancies with the declaration of Gjin Gjoni’s assets, they said they had also identified false documents. The Prosecution suspected that the Judge could put the evidence in danger, and asked his suspension. Both requests were rejected.
