The intervention of the EU Commissioner for Enlargement, Johannes Hahn, made all the parties agree on this historic reform.
Top Channel received Mr.Hahn’s letter which specifies the red lines that were respected. The International Mission Operation, same as printed on the draft brought by the US Embassy, will be part of the Albanian Constitution.
As this draft had specified, the International Mission will only collect facts and make recommendations, but the decision-making will be up to the Vetting Commission. But, as the Democratic Party requested, there will be explanations for each case.
The institution that manages the candidates for the new four institutions will not be the Ombudsman, but the President of Albania, as they agreed this Monday.
There are no more obstacles for the justice reform to pass his Thursday in Parliament with the consensus of all parties.
Letter sent by Johannes Hahn, EU Commissioner for European Neighbourhood Policy & Enlargement Negotiations, to the Albanian political leaders:
Dear Prime Minister
Dear Speaker
Dear Chairman of the Democratic Party
Further to my respective telephone conversations with all three of you yesterday and today, I would like to reiterate the following points on the so-called “hybrid proposal”, which is on the table. These points are red lines for the international community, as we have consistently stressed throughout the process.
First, the role of the International Monitoring Operation must have a solid legal basis on the Constitution itself.
Second, I reconfirm, as we have stated throughout the discussions, that the IMO will only provide recommendations which are not legally binding. However, these recommendations will include a reasoning in which the position taken will be explained according to the criteria established by the legislation.
I trust that we can proceed on this basis. As discussed, please confirm this by rapidly replying to this message, so the vote in Parliament can be held tomorrow.
