Constitutional Court leaves in effect suspension of fine-harshening law

The Constitutional Court left in effect the suspension of the law for
harshening tax procedures, until a final decision is taken within the
month.

The Association for Protection of Merchants and the Market filed a complaint against this law in December, asking for the Court to repeal laws they saw as against the Constitution.

According to the business representatives, the law goes against the constitutional principles and does not have the right ratio with the damage that is caused to the government.

The representative of the Ministry of Finances said that the unification of the fine for any violation aims to fight informality in economy.

The members of the judge panel requested studies on what the fine increase was based, but the government representative did not make it available.

The Court also asked any similar case in EU countries, and said that for violation that has a 500 EUR fine in Italy, in Albania you are fined ten fold.

The decision to keep the law suspension in effect is read by businesses as a positive decision that will be followed by a repeal of the articles that make fines harsher. They declared this Friday that they will file a complaint for the Criminal Code too, which provides prison sentences for offenders.
