Xhakja free did nto have the arguments published, according to the law,
the Tirana Prosecution has started the investigations against Neritan
Tabaku, the Judge who has failed publishing the arguments that explain
the verdict, by keeping this way in suspension Xhake’s trial at the
Court of Appeals.
The case will be investigated by a task force Prosecution, Julian Zonja, while the Prosecution will address soon with a request to the High Council of Justice for removing the immunity of judge Tabaku, who is now under investigation for power abuse.
A few days ago, Top Channel published the documents showing the Prosecutor’s appeal about the First Degree Verdict, when Xhakja was found innocent for the murder of Qerim Maloko.
The appeal has been filed on 18 February 2011 and the case has not started since then, since the court doesn’t have the verdict.
The HCJ has received all files for the case that found innocent the 38-year-old man accused of murder and who has just allegedly killed a Chief of Police .
The HCJ is not inspecting only the verdict of Neritan tabaku, Fejzo Hysi and Ndue Gjura, but also other materials for the case.
Sources said for Top Channel that during these days, the Court has published the arguments for the verdict that set Xhake free and that blocked the appeal for more than 20 months.
The Court of Serious crime has left Xhake in prison for four charges, the most serious of which is the murder of Chief Adem Tahiraj.
