Besides the Minister of Justice, Nasip Naco, there are other voices speaking up about a reform at the High Council of Justice.
The head of the Criminal Lawyer Association, Saimir Vishaj, thinks that the HCJ reform should start by amending the law for the organization and functionality of this institution, which has been reformed for the last time in 2005. Vishaj thinks that the HCJ has overcome the limits within which they should exert their functional duties.
“HCJ has turned into a policy-making organ recently, not as a court that judges and values the work of the judiciary. Now they get involved in policies about courts that need to be merged or created. This can be fixed only by changing the HCJ law”, Vishaj declared.
But what amends Vishaj thinks that should be made to the law?
“It should be seen from the moment that members of the Judiciary Conference are appointed, and to the appointing of members that come from the Parliament. Today we have two or three members of the HCJ who have nothing to do with the judiciary. They come from the civil life and decide for the justice system. This is absurd”, Vishaj declared.
Vishaj also thinks that a good formula that would work to avoid a delay of the judiciary is the merging of the Constitutional Court, and passing its special chamber to the High Court.
