The Socialist candidate for the High Council of Justice, Ardian Visha,
declared for Top Channel that his defense as a lawyer to the former
Minister of Justice, Fatmir Mediu, for the Gerdeci tragedy case has no
relation with his candidacy.
Visha declared that he made his duty as lawyer, and he underlined that he has respected the Constitution in every case that he has had.
TCH: Mr. Visha, the discussions today focused on your declaration about the innocence of Minister Mediu, regarding his implication with the Gerdeci tragedy. The opposition supports your candidacy, while you share other opposing opinions on this issue. Is your relation with the opposition a surprise, or they had taken these costs in consideration?
Visha: The SP proposed my candidacy based on their evaluation on my person and my service to justice. The High Council of Justice should be composed of people who have no relations with the politics. I believe that my contribution as a lawyer has been an effort to respect the constitutional rights that are offered to me.
TCH: You and the Socialist MPs at the Commission of Laws asked that Ardian Visha as a lawyer should be seen differently than Ardian Visha as a High Council of Justice candidate. Do you think that the lawyer’s profession and the HCJ Chairman’s duty should be united by the moral of law and justice?
Visha: Certainly that they are joined by moral and trust to the law. These to things are not conflicting, and they are completely present in me.
TCH: Gerdeci and the state crime accusations were a strong political element and Mr. Mediu was the center of this war. If HCJ would review tomorrow cases regarding Gerdeci, how would you resolve this dilemma between those who proposed you and the person that you defended?
Visha: HCJ is an institution that controls the judge. HCJ is at the same time a prosecutor and a lawyer, with the goal to check their activities. As for Gerdeci, I am not the lawyer of the tragedy. I have contributed in defending an individual and I have done my job.
TCH: You have asked the majority’s votes. Have you made any list for calculating the votes that you could receive from the majority?
Visha: I have made no calculations, but an analysis. The main element was the desire to candidate, to have a HCJ member that comes from the society. There can be no future in justice, if it will not be detached from politics.
TCH: Do you fear that your stances in the commission will make you lose votes from the opposition?
Visha: I’m not afraid about this. I prefer losing with the votes of both parties, rather than winning with partial votes.
