Videoscandal divides court

The Penal College of the Supreme Court has been divided in two different
positions for the case of the accused Deputy Prime Minister, Ilir Meta.

Same as for the proof order, the Penal College judges were divided among them even for the assignment of the technical experts who will inspect and verify the video-scandal Meta-Prifti.

After the Penal College announced the intermediate decision for the experts that will investigate the video, Top-Channel secured from unofficial sources the two different positions of the Penal College, where what catches the attention is the argumentation of the rapporteur of the judge panel, Ardian Dvorani, who remains opposed to the other judges.

For contesting the hiring of Albanian technical experts, Dvorani argued that the Court should keep in consideration that in high profile events, cases with complexities or of extraordinary difficulty, they have always asked the opinion of foreign experts.

“This consolidated practice has not only been based on law, but its effect was for guaranteeing the trust of the interested parties and the general opinion, for the sake of justice and the normality of the investigation,” Dvorani declared.

“For the nature of the case itself and the personality of the defendant, a politician and high-rank state official; and also that of Dritan Prifti, the politician and high-rank state official who recorded the conversation; for the historical status of the scandal and the development of the institutions involved, I have the conviction that the technical experts should have been chosen among experienced experts in official entities and scientific forensic offices of a western country,” Dvorani added.

The rapporteur added that “even if the experts would be selected in the country, as they were selected, their selection should be made among the experts who exert their profession outside public institutions and that do not have real or potential possibilities of being influenced.

“Otherwise, we would not be able to distinct these persons from those who have the qualities of an expert and exert their duties at our state administrated institution of the scientific police,” Dvorani declared.

But regardless these detailed argumentations of the rapporteur Ardian Dvorani, who remained in minority and alone in the intermediate decision, the four other judges of the panel decided the fate of the video, which apparently this time will not be inspected in US or UK as in the previous time.

On Friday September 23rd, the technical experts Ardian Pollo, Ermal Beqiri and Artur Rahmani will be the people who after taking their vow, will analyze the video-scandal and will say their word, words from which depends the fate of this judicial process.
