Three decrees for two vacancies

President Nishani decrees the new members of the Supreme Court and Constitutional Court

A press release from the Presidency stated that The President of the Republic, Bujar Nishani, decreed the appointment of Mr. Xhezair Zaganjori as a member of the Supreme Court. President Nishani also decreed the appointment of Mr. Besnik Imeraj and Gani Dizdari as members of the Constitutional Court.

The Constitutional Court had a vacancy since 2010, when Petri Plloci resifned and was replaced by Artan Hoxha, a former member of the Supreme Court.

Former President Topi passed the decree at the Commission of Laws, but it hasn’t been voted in Parliament since then.

While this decree was not voted yet, the former President decreed two other names for the vacancy, and also decreed the transfer of Mr.Zaganjori to the Supreme Court.

These decrees come a few days after the President met with the Parliamentary leaders, in which the President declared that he considers the decrees signed by former President Topi as effective.

The opposition reiterated the fact that the proposition has been idle in Parliament for a long time, referring to Topi’s decree.

“The President consulted us regarding the two other vacancies at the Constitutional Court. For us there are no vacancies today, because the Constitutional Court and the Albanian Parliament agreed that these mandates end on 21 May 2013. For us it is ant constitutional if the President decrees the two new mandates without having a vacancy at the Constitutional Court”, declared the SP Parliamentary Group leader, Gramoz Ruci.

Constitutionalist experts confirm that there’s a conflict in this case, since there cannot be three decrees for two vacancies. But they say that the President might be preparing it for another vacancy on April. Experts underline that the President cannot appoint a new member before the mandate of the incumbent is expired.
