The next justice scandal

Reliable Prosecution sources declared for Top Channel that they addressed the HCJ to inspect the development of the judicial process in all court levels for the case of a 34-year-old from Mamurras, accused of the intentional murder of Leonard Rama, 25, and for a fatal hit and run that took the life of Lutfi Aliko.

The Prosecution has suspicions not only for the punishment of Marin Koka – who was sentenced with 1.5 years to prison for two charges, “murder” and “illegal fabrication and possession of a weapon” – but also because the author had confessed the murder through the lawyer.

The sources confirm that the scandal started with the first trial, when the defendant was running from the Albanian police. The lawyer of suspect Agim Hysa presented a procure for the presentation of Hysa, signed by him, after proceeding the document at notary Zaloshnja.

The Kurbin Court sentenced Koka to eight years in prison. The court of Appeal left this sentence in act, but when the case went a Supreme Court, another lawyer declared that the former lawyer had presented falsified documents, which means that the defendant had not had the right to defend himself. On May 2010, the Supreme Court changed the former decisions and ordered the review of the case at the First Degree Court of Kurbin.

The Prosecution declares that the court gave the short sentence unrepentantly, without allowing the defendant to be heard, since now he was under police custody, after being deported from foreign law enforcing authorities with falsified ID.

The Prosecution declared that the HCJ was partial with the decision, starting witht he rejection of a normal trial, and continuing by giving the decision in which the judges changed the charges from “intentional murder” to “murder under psychological trauma”. According to the Prosecution, the change was made when the case had the same evidence of the first trial.
