
The Parliamentary Commission of Laws approved the majority’s request for
discharging the vice Chairman of the High Council of Justice, Kreshnik
Spahiu. The opposition opposed this process by considering it an issue of the Democratic Party.
The vice Chairman of the HCJ appeared in the Commission, where was heard the relation of the Democratic MP, Viktor Gumi, who presented the request for Spahiu’s discharge. The request argues that Spahiu has deviated from the constitutional functions and has replaced it with political activities that fall against his duty, by not representing the interests of the institution that elected him, the Parliament, in function of justice.
But the session started with debates and tensions. Rusmali sent Spahiu outside the room after the second person in charge at the High Council of Justice argued that their efforts for discharging him were ant Constitutional. The opposition member of the Commission of Laws, Fatmir Xhafaj, underlined that what is happening with Spahiu is something ugly and the opposition doesn’t want to be part of.
“You must establish an investigative commission for the situation of justice in the country. For you, Spahiu was a justice fighter yesterday, and now you call him a charlatan and thug”, Xhafaj declared.
Spahiu: A serious negative event in the history of Parliamentarism
The HCJ vice Chairman, Kreshnik Spahiu, reacted regarding today’s meeting at the Commission of Laws, when he was obliged to leave the room, after the request of the Chairman of this Commission, Ilir Rusmali.
Spahiu accused Rusmali of denying him the right to speech, and for making open pressure with the discharge request.
“The offences continue for more than one year, from the head of the government to the MPs. They have lost everything and they fear the future. They called the security guards for sending the HCJ Chairman out of the office, which is a serious event in the Parliamentary history and democracy in Albania”, Spahiu declared.
“I will never participate in the works of the investigation commission. When this government is unable to hear the voice of a high rank official, how will they be able to hear the voice of a common citizen? We will prepare the material that will be sent to the Constitutional Court, for the anti-constitutionality of this commission”, Spahiu declared, by underlining that the country is facing today a modern dictatorship.
The quick decision of the majority
The Democratic Chairman of the Commission of Laws, Ilir Rusmali, summoned today’s meeting two days after the request of the Democratic Party MPs was made public by Prime Minister Berisha. The regulation obliges the members of a constitutional institution to be heard in front of the commission, before he sends the report to the Parliament for the establishment or not of the Commission.
The Democrats say that the Commission will verify the violations of the HCJ vice Chairman in the next three weeks.
“This is against the Constitution and the law for the organization and functionality of the HCJ, the vice Chairman of which cannot be fired by the Parliament. The government has nothing to do with an independent institution. How can this government, in 2012, try to control and hit the justice”, Spahiu declared, by considering it a clear political attack.
