SP withdraws from “election invalidation”

There was a sudden turn at the Electoral College, which
was expected to review the appeal of the Socialist Party for considering
the elections as invalid.

The request was rejected by the Central Election Commission with two arguments: first, CEC did not have the competences for reviewing the case, and second, the deadline for presenting the invalidity request had expired. After this rejection, the request arrived at the Electoral College. Another invalidation request was filed by the Pensioners Party, which is allying with the left centered coalition. Right after that, the Socialist Party itself, within the time limits offered by the law, filed another appeal that requested the Electoral College to oblige CEC to review the appeal that they had rejected before. This is what the Electoral College was about to review today. In these conditions, the Democratic Party requested the unification of the three requests, since the basis was the same: elections invalidity.

The judges gave some minutes for enabling the parties to study the request of the Democratic Party for joining three requests in one. The session started some minutes later, in the presence of the interested parties and media. In this moment, SP lawyer Arian Salati requested the Electoral College to reject the DP request. DP lawyer Ivi Kaso called this a diversion and mistrust towards the Court, because under the Civil Code, the plaintiff has a categorical disposal to withdraw from the case or to request the closure of this case. This is what the Court decided, and the case was not taken under consideration.

The other SP appeal, which asks the Electoral College to order CEC to review the invalidation appeal, will be reviewed this Thursday. If the Electoral College will rule in favor of the Socialist Party, the appeal will follow the line of the Electoral College and CEC. But if the request of the Socialist Party will be rejected, the Democratic Party is one step away from victory. In this case, the Electoral College will review only the request of the Pensioners Party for considering these elections as invalid.
