SP: Slander and offence will remain a crime

The opposition and the majority at the Commission of Laws have approved with consensus the qualified majority laws.

In parallel with the Civil Code, they are discussing further amends in
the Penal Code, the main focus of which is on the government draft law
for removing slander and offence from the penal code. This initiative of
the majority is seen as a concrete action for defending journalists
from penal processes and treating these accusations as civil trials.

Although
the opposition approved in principle the amend of this article,
together with others, they insisted that slander and offence should stay
at the Penal Code, but to not provide imprisonment measures, as it does
currently, but only fines. This proposition will remain in power, so
that the Penal Code amends are passed with consensus.

Proposition for domestic violence: Beating, up to 5 years in prison

Another amend that will be discussed at the Commission of Laws, was that of the domestic violence.

The
Democratic MP, Viktor Gumi, proposed that the beating and every other
violent act committed by a person who lives or has lived together with
the victim, will mount to 5 years to prison. This amend brings a new
concept to the Penal Code, which allows the judges to decide that the
offenders who commit domestic violence with cruelty or when it is used
against children or pregnant women, will not be able to benefit amnesty
or probation without serving 2/3rd of the sentence.
