Linda Rama: Between Family, Work and Albania’s Future The Socialist Parliamentary Group submitted a request at the
Constitutional Court, asking a review of the Parliament decision for the
distribution of Parliamentary seats according to districts.
The 30-pages-long request has arguments why the voting is anti-constitutional.
The two main requests sent to the Constitutional Court are:
“Repealing the Albanian Parliament Decision nr.2/2013, dated 31.01.2013, ‘on the distribution seats per electoral area in the Elections of 2013’, and the suspension of this decision.”
SP argues that the Constitutional Court has all possibilities to give priority to this issue and take in consideration its actual significance. As for the damage made to the vote equality principle, the SP request says that the Constitutional Court has had the opportunities to elaborate the vote quality principle and its components.
SP says that “the right to vote is constitutional and plays a key role in the election process. This right sanctioned by article 45 of the Albanian Constitution is known as the right of equal votes, and that all citizens are equal in the elections. The vote equality and the equality of candidates is the concretization of equal political chances, which are necessary for realizing a fair electoral process.”
SP says that seven of the Central Election Members voted against the decision stopped CEC from deciding the distribution of mandates and pass that competency to the Parliament. Since this decision is invalid, SP says that the distribution of mandates remains a CEC competency.
MP Damian Gjiknuri, SP Secretary on Electoral Matters, explains what they aim to achieve at the Constitutional Court.
“This decision is an alarm bell for the functionality of the rule of law. We have mentioned in our researches that similar decisions were taken in Nazi Germany, when the Parliament ignored all other institutions. If this injustice will go unnoticed and uncontrolled by the Constitutional Institutions, it will turn into a dangerous precedent that will damage the Albanian democracy in the future. One of our goals is to show to the Albanian people that we will do everything possible against injustices”, Gjiknuri declared.
