SP: Ministry of Defense violated Constitution

Socialist MP Erjon Brace declared that the arming of the Military Intelligence Service is in full violation of the law, which sanctions the activity of this organism inside the Ministry of Defense. Brace gave as argument the legal base on which the MIS should operate, what according to him was completely ignored by Imami during a media announcement this Thursday.

“The unconstitutionality in the Armed Forces activity and corruption are today’s greatest risk to national security. The unconstitutionality in the Ministry of Defense activity, particularly MIS, poses a great danger to democracy. This is the law, which Minister Imami ignored yesterday even to refer to throughout his statement. Based on this law, in Article 2, the MIS mission is to collects, analyze and manages data for activities that affect national security, potential threats or risks to the Armed Forces, that come from outside or appear within the country, in order to present them to the Armed Forces authority.
Article 5: MIS, in the implementation of the above mission conducts and performs these tasks: collects, analyzes, and presents information on activities which threaten and endanger the country’s integrity, constitutional order, defensive military plans and the realization of the Armed Forces’ mission. The mission and tasks of the MIS are only the collection, analysis, presentation of information regarding only to the Armed Forces activity of the Republic of Albania, ” Brace declared.

Brace invited the Prosecution to start investigating the arming of MIS, since one of the articles gives to the Prosecution all attributes to control the activity of this service. The Socialists suspect that the Prosecution has not implemented this article that is demanded by law.

“Arming MIS with special handguns, silenced handguns, with automatic and combat weapons and snipers, only two days after January 21st, is a serious Constitutional crime. For this reason I asked the Prosecution and I will keep asking them to start investigating the crime that has been realized with the signature and stamp of Minister Imami”, Brace declared.

Referring to the official document, Brace published the fact that with Berisha’s signature was asked the inspection of the Ministry of Defense regarding the purchase of weapons, including the military and logistic ones for MIS.

Brace declared that the conclusions of this inspection would be made public in the next day, since SP has the entire documentation for this issue. The Socialist Party reported the abuses of the Ministry of Defense by bringing documents for the purchase of weapons that mount to more than 1.6 million USD.

The Ministry of Defense: We bought ammunition for the MIS officers

The Ministry of Defense reacted through their spokesperson by saying that Berisha’s request for inspection is legal.

The Ministry admitted that they bought weapons for the Military Intelligence Service, and accused MP Brace of having connections with the spies that are controlled by the Socialist Party.

“MIS has not bought snipers for only one administrative reason, not for legal ones. MIS cannot be armed illegally, but it is armed for the personnel that puts its life to danger. MP Brace has connections with spies of the former communist Security, that are controlled by the SP. Every institution is controlled, but according to the law”, the Spokesperson declared.
