
The Socialist Party blamed high-level experts who assisted the Commission of Laws for the Judiciary Reform about the Criminal Code amends for which the Democratic Party accuse Fatmir Xhafa of having altered them to avoid extradition of his brother in Italy,
“The article in question was amended on March 13th 2017, the first meeting of the Commission of Laws in which was discussed the draft law for amends of the Criminal Code Procedure, Article 491.F”, declared Socialist MP Ulsi Manja.
Vasilika Hysi, who presented the draft, admitted that she didn’t study the additional protocol properly.
“The written opinions brought by OPDAT and the Prosecution General said that article 491 should be reviewed. The draft-law filed by me has not been falsified, but improved”, the Socialist MP said.
The amend says that extradition can be refused if there are no guarantees for retrial, when the defendant has not been offered minimal protection. The minimal protection law cannot be found in the Albanian law, which is very general, allowing anyone to refuse extradition if the other country doesn’t allow retrial.
“We have done the general work without going into details”, Hysi said.
This generalization allows Agron Xhafaj to not be extradited to Italy, although he had been offered minimal protection in the process.
