Referendum for waste materials

Albanians will vote on 22 December 2013 to decide if they want imported
waste materials in Albanian or not. The date of this referendum was
decreed by the Albanian President, Bujar Nishani.

The referendum initiated by the Alliance Against Waste Import aims to repeal articles 22.3 and 49 of law 10463 “For Integrated Waste Management”.

The Presidential decree is followed by a relation that shows the entire timeline since the request made at the Central Election Commission by the end of 2011, its admission in June 2012, including its admission by the Constitutional Court.

The Presidential Legal Office clarifies that based on article 119.2 of the Electoral Code 2003, no referendum can be held 6 months before the end of a Parliamentary mandate and three months after the first meeting of a new Parliament.

The leaders of the Alliance Against Waste Import says that these imports fall against the national strategy for stable development and for developing tourism, which has been declared as a strategic priority of the government.

This alliance has ranked a series of reasons why the Waste Import is a dangerous act, although the government has declared that Albania has all the controlling capacities in the entering points.

But the Alliance Against Waste Import thinks that since Albania doesn’t have the capacities to treat the waste materials, the import will deteriorate the level of pollution in Albania. Before thinking about importing, Albania must treat the domestic waste.

Another reason against this law is the lack of administrative capacities, the lack of legal and monitoring infrastructure, which makes the waste import in Albania more difficult. Mafia organizations might turn Albania into ha destination of dangerous wastes. For AAWI, this falls against the Aarhus Convention, since this decision was taken without consulting the community that will have to live with that.
