“Pyramid” case: will it be demolished or not? A group of MPs denounced
the law for the construction procedures of the new Parliamentary
Complex.
Genc Cifligu argued that the law has violated the local administration competences in urban planning and territorial management. The lawyer also declared that the law does not provide the financial bill of the new Parliamentary Complex, while the Constitution Provides that the laws should have a detailed summary of the financial cost.
Artan Lame argued that the International Center of Culture is a cultural monument, and the argument that this status has been removed is senseless.
Lame says that according to the law of cultural heritage, a building either has the values or not. When there are natural disasters, the Minister of Culture has the right to interfere with the status “Monument of Culture”.
With these arguments, Genc Cifligu and Artan Lame asked for the law of the new Parliamentary Complex to be declared as anti-constitutional.
The representatives from the Parliament and Council of Ministers declared that the law does not invade the local administration competences. But more than this argument, they valued the fact that this group of opposition MPs is not legitimized to address this request to the Constitutional Court. According to the representatives from the Parliament and the Council of Ministers, the way the request has been compiled shows a conflict of competences, and in this case, the only institution that can address this request to the Constitutional Court is the Tirana Municipality.
The representative of the Council of Ministers went even further, by saying that these MPs have not even participated at the Parliamentary sessions for discussing the law or for passing it. The Parliament and the Council of Ministers asked for this request to be rejected. The Constitutional Court has no deadline for taking the decision, which is considered as very important for the significance of this matter. The Civil Society asked the preservation of the Pyramid and its revitalization. The Albanian President did not decree the law, which entered in act with the President’s silence.
