Prosecutors: Remove immunity

The Prosecution insists that the MPs and judges should have limited
immunity by law, so that the investigation teams will not be hampered
while collecting evidence.

During an interview for Top Channel, the head of the Prosecutors’ Association, at the same time Main Prosecutor of the Court of Appeal, Shkelqim Hajdari, declared that the authorization for immunity will be asked only when the arrest measure or charges will be communicated.

“High rank officials, MPs and Judges, can be inspected by the investigation teams for collecting evidence. As for the cases when a judge or MP will be arrested to prison, the charges and the announcement of the measures should not be made by the prosecutors and judges, but it should be for the judges of the High Council of Justice”, Hajdari declared.

Different from the Union of Judges, which defends the immunity limitation version for judges only in cases of corruption, the head of the Prosecutors’ Association declared that the limitation should be for all penal acts.

“One of the best variants is to secure the investigation institution, and the Prosecution that can hold investigations not only for concrete penal acts of corruption, but for any kind of penal act, until the Prosecution will start building a case and asking the arrest of a high rank prosecution. The arrest of an MP or judge should be up to the HCJ”, declared the Head of the Prosecutors’ association, Shkelqim Hajdaraj.

The stance of the Prosecutors’ Association is on the same line with the declaration of the General Prosecutor, Ina Rama.
