Prosecutors challenge Judiciary Reform at Constitutional Court

The Union of Prosecutors filed a request at the Constitutional Court for
repealing several articles of the new Criminal Procedure.

The Union raises concerns that the new code limits the constitutional competences of the Prosecution.

Their request includes at least 7 articles of the Criminal Procedure, which, according to Prosecutors, violate the Constitution by passing their competences to Courts.

The Union says that by removing these exclusive competences, this institution is not allowed to exert its constitutional activity, damaging this way the principle of balanced powers.

The Constitutional Court is currently reviewing three other laws of the Judiciary Reform, the most important of which is the Vetting Law. Judges want to declare anticonstitutional the part which vets the image of judges.
