Prosecution accuses Ministry

The Prosecution Council, gathered for discussing the Ministry of Defense
Report at the Parliament, accused the Ministry of manipulating the
statistics for 2011.

The declaration of this council says that the terminology used for this report attacks in a direct and aggressive method the public safety of the citizens, eliminates the penal purposes, undermines the public trust of the police and prosecution, all of which is coordinated with the manipulation of statistics, showing the non-professionalism of controls and a tendency for negative senses, deviating from the spirit of the law.

The Council has rejected all points of the Ministry of Justice, clarifying that the Prosecution is not the one that makes the punishment politics, but the courts,l and their verdicts make the punishment politics in general even for specific acts.

Ministry of Justice reacts

The Ministry of Justice reacted after the declaration of the Prosecution:

“The Ministry reconfirms the trust that the principle of power division should not be understood for every power to be closed and uncontrollable by anyone. Article 48 of the Constitution appoints the Prosecution as the only Constitutional institution that has the mission to defend the rights and freedom of the citizens who are damaged by crime”, the Ministry’s declaration says.

“If the Prosecution acts independently and without being controlled by the Constitution, the public in general will be threatened. There are mechanisms at the Ministry of Justice that serve for avoiding the latter”, the declaration continues.

“The second reaction of the General Prosecutor on Media by using the Prosecutor’s Association and the Prosecution Council falls against the facts and the public trust on the Prosecution. The Minister of Justice reconfirms that the Ministry’s activity is oriented for respecting the rule of law. Therefore, we ask more seriousness and commitment for a coordinated identification and review of the cases where the law has been violated, which on first glance might seem like formal violations, but in fact are an important indicator of the quality increase of justice”, the Ministry of Justice concludes.
