Private bailiff in a stalemate

The National Chamber of bailiffs raises the alarm that an instruction
given by the Ministry of Finances, in cooperation with the Ministry of
Justice, have blocked the entire bailiff service in the country.

“The bailiff service is in collapse, and 90% of its activity has been suspended. This is seen clearly in the files that have been registered, which you can see at the data of the Ministry of Justice, the number of which is decreasing due to this instruction”, declared Petrit Qarri, chairman of the National Chamber of Bailiffs.

The instruction which entered in effect two days ago changed the fees that banks pay for the bailiff service, by turning them from fix fee to success based fees. According to the bailiffs, the new scheme is evasive and this has created a stalemate.

“Banks don’t find consensus about how to approach the bailiff service through the success tender. They don’t know what they will consider success and what we will accept as success. The second problem is that support of the state police. The General Director has given an order, which has been appealed at the Court. This specifies cases when the private bailiff service will receive support”, Qarri underlined.

According to the bailiffs, the new instruction has technical mistakes that make it inapplicable on terrain.

“The spending was given to the debtors. There are technical mistakes”, added the Head of the Chamber of Bailiffs.

Albania is the country with the highest level of bad loans in the region, which mounts up to 25%. Reinforcing the bailiff executions has been one of the main recommendations of the International Monetary Fund and the World Bank for reducing the risk of the financial system and the country’s economy.
