President Bujar Nishani returned the law for treating the private property, saying that it is not effective.
“The scheme offered through this law for offering a solution to a systematic and repeated problem regarding the failure to implement decisions for compensating land owners, who have a final verdict, goes against the constitutional principle of legal security and is not effective as requested, referring to the pilot decision Manushaqe Puto and others against Albania”, Nishani said.
The president says that the scheme offered through this law for treating new files and those that have not been opened yet, falls against the constitutional principles of legal safety, law equality and the right to complain.
After presenting his full arguments, the President says the law falls against the European Convention of Human Rights, the European Court of Human Rights and the Constitution of Albania.
