
The Prosecution made another attempt for changing the arrest measure for the National Guard Commander, Ndrea Prendi.
The Prosecution addressed to the Court of First Degree with the argument that there were new evidence against Prendi, in order to to change the house arrest measure to imprisonment.
The Prosecution presented at the Supreme Court an order that showed that Ndrea Prendi had retrieved a pistol barrel a few days after the killing. According to the Prosecutor, this new evidence aggravated the charges against the National Guard Commander, Ndrea Prendi, who is accused of killing the protester Faik Myrtaj during the January 21st protest. According to the Prosecutors, the evidence was attached to the ballistic tests that were conducted at the FBI labs, which showed that the pistol owned by Ndrea Prendi had killed Faik Myrtaj.
The Prosecution accused Prendi of having destroyed his weapon by changing the barrel with that of his driver’s. They presented written evidence, an mandate that showed that Prendi had retrieved a new barrel for his weapon, a few days after the event.
The former National Guard Commander was absent in this session, but his defense asked the court to leave his house arrest measure unchanged. Judge Shkelqim Mustafa decided to reject the Prosecution’s request, by arguing that the Court of First Degree had already decided once about this issue and that the new evidence should be presented at the Court of Appeal.
The next session will be at the Court of Appeal, next week, in which the Prosecution will try to change the decision of the Court of First Degree in Tirana from house arrest to imprisonment.
