Parliament discharges Spahiu

The Parliamentary Investigation Commission headed by the Democratic MP,
Enkelejd Alibeaj, which was created to assess the work of the vice
Chairman of the High Council of Justice, Kreshnik Spahiu, before he
resigned, concluded the report with a series of accusations against him.

 The Commission has found a series of legal violations made by Spahiu, such as avoiding the tasks as vice Chairman of the High Council of Justice; abandoning his working place for long periods of time in function of his personal political agenda; exerting foreign diplomacy; commenting laws; refusing to present official acts; violating the Constitution in the accountability aspect; avoiding the responsibilities for his actions, etc.

The Chairman of the Investigation Commission, Alibeaj, declared in front of the MPs that they have not received Spahiu’s resignation, and even if this would have happened, the law for the HCJ functionality obliges the member of this institution to continue his duty until a further replacement. For this reason, Alibeaj asked the Parliament to discharge Spahiu.
As conclusion, the Investigation Commission accused Spahiu of deviating from the Constitutional functions at the HCJ; of replacing it with political activities and leaving the duty for more than 30 long-term missions in order to repeat his personal and political agenda.

The Commission proposed the Parliament to approve the nine points of the reports:

1)    Proposing the Parliament to approve the report
2)    Recognizing the damage made to the HCJ member image, made by Spahiu
3)    Releasing Spahiu from his duties
4)    Reelecting the HCJ chairman
5)    Filing the report at the Constitution
6)    Submitting the report at the HCJ
7)    Immediate interruption of Spahiu’s work
8)    Sending report to Supreme State Audit
9)    Considering a possible reform for the HCJ

The Parliament “discharged” Spahiu with 64 votes in favor and 54 against.
