
The Parliamentary Commission of Laws will gather this Wednesday to
review the request of a group of Democratic Party MPs for establishing
an investigative commission for inspecting the performance of the vice
Chairman of the High Council of Justice, Kreshnik Spahiu.
The meeting of the Commission of laws comes after the declaration of the Prime Minister, Sali Berisha, who asked the procedures for the dismissal of Kreshnik Spahiu. The majority accused the vice Chairman of the High Council of Justice, at the same time leader of the Red and Black Alliance, of serious infringements of the Constitution.
“The truth is that this party of the HCJ, is a direct party of the Chairman of the HCJ (The Albanian President), which is a flagrant violation of the Constitution, the laws of the country, and which has allowed itself to use the Constitutional institutions in an irresponsible way for the partial interests, by seriously violating these institutions”, Berisha declared in front of the DP Parliamentary Group.
The vice Chairman of the HCJ, Kreshnik Spahiu, considered Berisha’s initiative as anti-constitutional that damages that independence of the constitutional institutions, and also as a clear political attack.
“The request for my dismissal, by a group of Democratic Party MPs is against the Constitution of the country. This is against the Constitution and the law for the organization and functionality of the HCJ, where the vice Chairman cannot be dismissed by the Parliament. The government has nothing to do with an independent constitutional institution. The government has nothing to do with the judicial system. How can a government of 2012 attempt to control and hit the justice”, Spahiu declared.
In another reaction, Spahiu declared that the Commission was gathered 24 hours after Berisha requested his dismissal. However, he confirmed his participation in the Wednesday’s session.
