Linda Rama: Between Family, Work and Albania’s Future The Constitutional Court started reviewing the request of the Albanian
President, Bamir Topi, for giving a final opinion by this Court in order
to resolve the competencies’ conflict between the Presidency and the
Albanian Parliament for appointing the Constitutional Court members.
The conflict between the two institutions was created some months ago, when the Parliament approved only one of the four Presidential candidates as members of this Court.
After an earlier Constitutional Court decision for the rotation of their members, the ruling party MPs assessed that this institution had only one vacant place, not four, as the Presidential decree had presented.
For this reason, the Parliament rejected three decrees, actions that were considered by the President as anti-constitutional.
The Presidency refers to the Constitutional Court request in 2010, which announced the expired mandates of four members. According to the Head of the State, this was not taken in consideration by the Albanian Parliament.
The Head of the Albanian State emphasized in the first session of this review that it is the core of the power divisions, the core of justice and Constitutional guarantees of these institutions.
