Omari: Venice? The implementation of the recommendation, a problem

After sending the four questions for May 8th elections to the Commission
of Venice, the opposition hope to receive an unbiased answer on what
they call “electoral manipulation”.

But the Commission of Venice has been articulated as an important adviser even in the attempts for making the Electoral Code amendments. At least this is what Astrit Patozi declared in his last letter sent to Gramoz Ruçi.

But Professor Luan Omari, former member of the Commission of Venice for eight years, declared in an interview for Top Channel that the Commission will need a lot of time before reviewing the request of the Socialist Party.

“The Procedure is a little long and complicated. First of all, the request has to go to the secretariat of the Commission, which will decide if it is within their competences, in order to assign their experts on the case. The consolidated opinion will be sent to each member of the Commission and will be reviewed by one of the four meetings that are held within one year”, Omari declared.

Prof. Omari added that more than the decision, the real problem in other precedents has been the implementation of the decisions or the recommendations.

 “The Commission of Venice has given very valuable help for the creation of the Albanian Constitution. It has also offered help and opinions for the Parliamentary immunity and Lustration Law. As for the elections, the Commission of Venice has given orientations and advices that have been taken in consideration only by lower level elections”, Omari declared.

Mr. Omari, also one of the co-planners of the Albanian Constitution, declared that the declarations of the opposition’s leader, Edi Rama, on Top-Channel’s program “Top Stoy”, about the amendments of the Constitution, were later contradicted by Prime Minister Sali Berisha.

“I am happy that Mr. Rama admitted the serious mistake. I have said and I repeat that they have changed the power sharing balance. I heard also Berisha declaring that he was ready to make amendments to the Constitution. If the ruling Democratic Party would not agree with the amendments, these words would be in vain, I think that this issue deserves to be discussed, because there will be a time when changes will be needed”, Omari declared.
