New Prosecutor General, new political crisis in sight for Albania

Top Channel warned a new crisis a few days ago, and this Monday, the Chairman of the Commission of Laws confirmed that the new justice institutions were suspended due to the lack of candidates from civil society.

“The Commission of Laws will wait for the process to be concluded with candidates from the civil society, and hold a parliamentary session for both councils”, declared Ulsi Manja, Chairman of the Commission of Laws.

This postponement could bring a new conflict between the majority and opposition, the appointing of the new Chief Prosecutor, as Adriatik Llalla is about to finish his term on December 3rd.

The new Constitution foresees that the term of the next Prosecutor will be seven years. The absence of a High Council of Prosecution is being seen by the opposition parties as a chance to postpone this appointment with two years.

For the majority, this is out of question and Llalla will have to go home on December 3rd.

The law says that the Parliament decides for the Prosecutor with most experience and who fulfills some conditions. If the Democratic Party and SMI will want to extend Llalla’s mandate, he will have to fulfill them as well.

Llalla fulfills the criteria for the 15-year-long experience and master degree,. But for him to be considered for the next two years, he must go through the Vetting procedure.

Even if Llalla comes clean after the Vetting, he will need consensus from all parties, since his name must be voted in Parliament. But will this provisory Prosecutor be voted with 3/5th of the Parliament, or just 71 votes?

“Our people and experts at the Commission of Laws will take concrete steps”, Basha underlined.

If the SP refuses to accept Llalla as the new Prosecutor, who will take his place after December 3d? It seems that the case is so complicated that only the Constitutional Court can resolve it, and they will be faced with one of their most difficult decisions in the past years.
