Linda Rama: Between Family, Work and Albania’s Future The majority voted a new amend for the Property Law, which excludes the Parliament from valuing properties for compensation.
“It foresees that the agency that performs the functions of property return and compensation now must be an agency that depends from the government and the Ministry of Justice. All acts that regulate the activity of the latter will be approved by the Council of Ministers”, Elona Syla declared, as director of the Legislation, at the Ministry of Justice.
The Socialists who abstained in the voting declared that this amend has a strong legal conflict.
“The discussion is in principle. My property cannot be valued by an institution that has undertaken the obligation to compensate me the property that I used to have. If the government has taken the right to compensate with a value in nature, the government cannot value my property, regardless the standards that it will apply, therefore, it will be the Parliament who will approve an institution”, the Socialist MP declared in this Commission.
But the government says that the new prices will be nearer to the market, guaranteeing the owners a righter compensation for the property that has been taken from them.
“The fact that law amends are being proposed is related with two important matters that have been mentioned by those who are directly affected by the property compensation process. It is related with the evaluation process and the pretenses for a real evaluation that corresponds to the market value, and it is normal that there can be similar pretenses”, declared the Chairman of the Economy Commission.
The new law also postpones the deadline for the property compensation to April 2014, because the government has not been able to prepare the compensation fund, although the deadline was in the end of last year.
“The least that should be done is to prohibit actions so that can transfer elsewhere this kind of wealth, even when they are dependent to the local administration institutions, or the local institutions prohibit this kind of wealth to be made available to someone, or make it available for give it for commercial use, on which other investments can be made, and then it would be difficult to take that from the people that are investing on it”, Brace declared.
“From 50.000 property compensation applications in total, 40.000 have been addressed to. We are talking for the smallest remaining part and we must not create the impression that this process has remained unmoved. In fact, its progress has been quite good”, Spaho declared.
According to the government, the new property prices will be implemented, and in some cases, expropriations for public investments and concessionary agreements for the construction of big projects will be implemented.
