The Prosecution lost the Court of Appeal battle for sending to prison the former National Guard Commander, General Ndrea Prendi, as the person who is under investigation for murder in qualifying circumstances and with cooperation.

Judges Artan Broci, Gjin Gjoni and Edmond Gogaj rejected the request of Prosecutor Nezir Gjoka, for changing the house arrest to imprisonment.

The Prosecution declared that after the examination made by the FBI labs, the weapon that killed the protester Faik Myrtaj is owned by Ndrea Prenda. Different from what was expected, the Prosecution did not present the document that proves that the weapon had been retrieved with the signature of Ndrea Prendi. Sources say that this document will be presented at other trials, due to another request that will be made at the Court of First Degree for the reevaluation of the measure, as the Penal Code requires.

Judge Gjin Gjoni did not ask the Prosecutor about this document, but asked Ndrea Prendi’s defensive lawyer instead,  who answered immediately by saying that the Prosecution was the one to be asked for this. The discussions in today’s session were more like a legal debate for the laws that sanction the weapon usage by the National Guard. The Prosecution insisted that the weapon usage violated article no.8290, while the defense underlined that the weapons can be used when under attack, and on that day there was an attack, even against Ndrea Prendi as a person, but he didn’t mention Prendi’s swollen eye that was seen on the media after January 21st.

Judge Edmond Goga interfered by asking the lawyer to tell the court about the attack he was referring to, by saying:
“Can you please extend the meaning of the term ‘attack’? Are you saying that they attacked the Prime Minister’s Office with punches?”

While for the former driver of Ndrea Prendi, the Court changed the First Degree custody measure by leaving him in “house arrest” with the obligation to present himself every Monday in court.
