Naco, critical to the Prosecution: “Did not implement criminal policies”

An inspection report of the Ministry of Justice at the Prosecution
during 2014 shows that the criminal politics of the government is not
respected at all. The Minister of Justice read the points of this report
and identified the huge problems found during the inspections in
Saranda, Durres and Shkoder.

“The Prosecution has failed to start cases of concrete people who have been reported, without making any verification or proactive decision by the Prosecutor. The Prosecution has failed to start cases when the report has not been made. This cause has not been included in the circumstances that do not allow the start of the procedure”, Naco declared.

The Minister of Justice said that he would not want to double the work of the Prosecution General, which has the duty to inspect Prosecutors. But he raise the concern that no Prosecutor has ever been sent for disciplinary proceedings.

“I have never seen this as an instrument against the Prosecution and I never intended to double their work”, Naco declared.

The Parliament Members of the Commission of Laws expressed their concerns and considered as flagrant not only the fact that Prosecutors are against the criminal policies of the government,, but also for the fact that the Prosecutor General did not answer to the requests of the Ministry of Justice, not even formally.

“I am concerned by the fact that the Prosecutor General fails to answer to the Ministry of Justice for the recommendations. This is an obligation that is recognized by the law for the Prosecution General. This is something repeated, because we had the same concern in the past year”, Xhafa declared.

The government asked for fewer sentences for minors and more alternative sentences for 90% of the cases when Prosecutors have requested a prison sentence.
