Minister’s declaration after Constitutional Court rejected law amend on illegal arm possession

The Constitutional Court rejected the request for harshening laws
against illegal arm possession. The government is determined to continue
with the plan.

“We are looking into positive models. I have encouraged them, and I have encouraged the experts of the police and the ministry to evaluate all variants. One of the variants is that the crime changes from illegal arm possession to preparation for an armed attack”, Minister Tahiri declared.

The Minister said that some judges have released people arrested for illegal arm possession, and this is unacceptable. The Minister says he has raised this concern to the President and the High Council of Justice.

On December 2015, the Constitutional Court rejected the amends of the Criminal Code for sentencing illegal armed possession from 7 to 15 years of prison, seeing it a sentencing measure that goes out of proportion.

After the decision of the Constitutional Court, the illegal arm possession is sentenced to fine or seven years in prison.
