“Mediu” case returned at Court

The Constitutional Court returned to the Supreme Court the case of the
former Minister of Defense, Fatmir Mediu, by accepting the request of
two of the Gerdeci tragedy survivors, Roxhers Durda and Alketa Hazizaj,
who asked the Supreme Court two years ago to criminally prosecute the
former Minister for causing serious injury by negligence.

The return of this case at court means that the immunity case of Minister Mediu will still be under discussion.

“The Constitutional Court found this decision inconsistent and decided to return the case for a review at the Supreme Court, where it should have been trialed since March 1st 2010, at least. The Supreme Court established some kind of wall on the trial that should continue against the Minister of Defense, and this wall has been abolished today by the Constitutional Court. We are talking about two cases, but the same will be for all other cases and for all other people that have been injured”, declared the lawyer of the injured victims, Dorian Metaliaj.

“This is a hope. It will not give us back what we lost, but this is a hope for all Albanian citizens”, declared Feruzan Durda, head of the Gerdeci Victims’ Association.

Two years ago, the Supreme Court rejected the request of the two injured victims for starting Mediu’s prosecution, while the two plaintiffs addressed the Supreme Court. According to the Constitutional Court, the Supreme Court should start the prosecution, because it is not its competency to reject a penal procedure which is a competency of the Prosecution. According to the Constitutional, the Supreme Court should assess the evidence and summon witnesses.
